Furniture Tech Terms of Service and Warranty

1)  CONTENT

Furniture Tech Bakersfield California, also known as FurnTech is individually, family owned and operated by the Blackmon Family, Copyright 1990-2010 Blackmon Enterprises.  This TOS will serve as Terms of Service for all services owned by FurnTech or Blackmon Enterprises, including the FurnTech websites, www.furn-tech.com and www.furnituretech.biz .

All services provided by FurnTech may only be used for lawful purposes. The laws of the City of Bakersfield, CA., County of Kern, State of California and the Country of the United States of America apply.  All Rights Reserved.

2)  AGREEMENT

This agreement herby nullifies, cancels and waives any previous agreements or contracts while using our services.  The seller of the services is herby known as Furniture Tech or FurnTech.  Furniture Tech is the seller of fine furniture repair services.   The Buyer of the services is herby known as the Client or Customer, even if that client is a residential, commercial, retail, manufacturer, warranty or insurance company.    The buyer is known as our client or customer.

2a) By using Furniture Tech services, you, the client or customer, legally certify that you are age 18 or older and are able, and have authority, to legally sign a legal contract representing yourself or your company.  By using our services you certify under penalty of law that you accept and agree to be bound by these Furniture Tech Terms of Service.

2b) At anytime Furniture Tech and/or the client may choose to no longer do business with each other and thereby terminating this Terms of Service contract, either party may only do so providing the client does not owe any fees or money to Furniture Tech.

3) ALL RIGHTS RESERVED

Furniture Tech reserves all rights, including but not limited to the following:

3a) FurnTech reserves the right to refuse service to anyone.

3b) FurnTech reserves the right to refuse service to customers that are being obnoxious, rude, vulgar or abusive in any shape, media or form to us or our FurnTech staff or partners.

3c) FurnTech reserves the right to turn down, walk away from, or reject a repair project or job with or without explanation.  Although FurnTech will usually provide an explanation, they are not required to.

3d) FurnTech has the right to modify the original estimate and/or repair cost should further damage be found, or should the customer add more repairs to the job not already included in the estimate.  The customer must approve these modifications.   Should the modified estimate not be approved by the customer, FurnTech reserves the right to repair just what was on the original approved estimate, or reject the job altogether.

3e) FurnTech reserves the right to repair any accidental or inadvertent damage caused by the FurnTech crew or their partners, instead of submitting an insurance claim, or hiring someone else to do it.   FurnTech reserves the right to be the sole entity that chooses a 3rd party repair service should FurnTech not be able to repair it themselves, as well, FurnTech reserves the right to choose how this 3rd party gets paid.

4)  WARRANTY

All Furniture Tech repairs come with a 90 day limited labor warranty on the labor of the repair area only, unless otherwise stated on the estimate or receipt, or an extended warranty is purchased from us.

If our repairs come loose or break within the 90 day warranty, FurnTech will fix it for free labor, this is for labor only; this does NOT include travel fees, parts, material, or supplies.  Customers will always be responsible for travel fees, parts, material or supplies.

4a)  Limited Repair Area Only: Our 90 Day Warranty is limited to the repair area only, and not the rest of the furniture piece or pieces.  The repair areas only refer to the exact area or spot on the furniture and of the damage that Furniture Tech repaired and nothing else.   Furniture Tech is not responsible if something else comes loose or breaks outside the area of our repairs.  Furniture Tech reserves the right to be the sole deciding entity of what damage is covered on our Warranty.

4b)   Misuse & Abuse Voids Warranty: Our 90 Day Warranty is voided and cancelled if Furniture Tech determines that the repair area or the furniture itself was misused or abused in any way.  Our 90 day warranty is voided if the customer messes with or harms the repair area at all.  Furniture Tech reserves the right to be the sole deciding entity of what constitutes misuse or abuse.

4c)   Warranty for Labor Only, Not Parts: Our 90 Day Warranty does NOT cover parts, material or supplies.  Furniture Tech goes out of its way to use quality products, but cannot be held responsible for the craftsmanship of a manufacturer’s product, that is out of our hands.   All parts, material and supplies are purchased ahead of the repairs, and so we do not offer any warranty on the parts, material or supplies, nor do we offer any kind of refund for parts, material or supplies as the money goes to paying for those parts.

If a part has broken, you the customer are responsible and will need to contact the manufacturer of the part, and have them send you a new part, (or purchase another one), and Furniture Tech will install it at no charge within our 90 day warranty.  If a customer calls us before the 90 day warranty is up, but a part, material or supply has to be ordered that won’t arrive until after the 90 day warranty, that customer will receive extra time on their warranty until the part arrives and we are able to install it.  The new part will also have a new FurnTech 90 day limited labor only warranty after we install it.

5)  PAYMENT & REFUND POLICY

All payments are due in full prior to, and or at the time of the appointment as listed below.  While Furniture Tech will reasonably go out of its way to address a customer’s concern, all sales are final.  Furniture Tech does not offer any refunds, exchanges, or store credit of any kind on, (but not limited to),  inspection fees, travel fees, labor, parts, material, or supplies.

5a)  Inspections & Estimates: Inspection and Estimate fees are due prior to or at the first initial visit of the inspection.  Our technicians will not perform the inspection until they are first paid the inspection/estimate fee, no exceptions.  Inspection/Estimate fees are non refundable.

5b)   Travel Fees: Travel fees must be paid in full and in advance of any appointments, no exceptions.   Travel fees only apply to customers outside the Bakersfield area.  Travel fees are not refundable.

5c)   Parts, Material, & Supplies: All parts, material and supplies are the sole responsibility of the client or customer.   If the customer wishes FurnTech to find and purchase parts, material or supplies for them, then all FurnTech finders fees, parts, materials and supplies costs will be paid in full and in advance of the repairs by the customer, not Furniture Tech.   These fees and product costs are not refundable and are due in advance.

5d)   Labor Fees:    (Please Note: We require a 25% advanced down payment on any labor fees over $600).  The customer agrees to pay labor fees at the time of the repair appointment, unless other arrangements have been made in writing by Furniture Tech. All labor fee balances are due in full, on receipt, the same day that the repairs are completed.  No Exceptions.   Any totals not paid by that day, are subject to late fees and processing fees.  Non payment will result in continued late fees and collection agencies, lawsuit, along with a possible lean on your property.  Please pay us on time.

6) PRICE CHANGE:

FurnTech reserves the right to change/modify the resources or price for services at anytime under any circumstances outside our open estimates.  Our estimates are open and valid for 30 days only.  After 30 days, you will need to get another estimate from us.

7) INDEMNIFICATION

Customer agrees that it shall defend, indemnify, save and hold FurnTech, its owners and partners, harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against FurnTech, its agents, its customers, officers and employees, that may arise or result from any service or product provided or performed or agreed to be performed or any product sold by the client or customer, its agents, representatives, officers, employees, companies, or assigns.

7a) Customer agrees to defend, indemnify and hold harmless FurnTech against liabilities arising out of any injury or harm to person or property caused by any products sold, used, repaired or otherwise distributed to Furniture Tech or the customer from another company.  Furniture Tech is not responsible for other manufactures products or the effects they may have on person or property.

7b) Furniture Tech is a solely owned entity, and does not represent, nor do we make decisions for other companies, businesses, or entities that may sub contract our services.  Furniture Tech is not responsible for any aggravation, views, harm or damage that may result from a company that subcontracts our services.  The views of these companies do not necessarily represent the views of Furniture Tech or its owners and partners.

8) ARBITRATION:

By using any FurnTech services, you agree to binding arbitration. If any disputes or claims arise against FurnTech or its subsidiaries, such disputes will be handled by an arbitrator of FurnTech’s choice. All decisions rendered by that arbitrator will be binding and final. You are also responsible for any and all costs related to such arbitration.

9) DISCLAIMER

FurnTech shall not be responsible for any damages your business may suffer. FurnTech makes no full warranties of any kind, expressed or implied for services we provide or products we use. FurnTech disclaims any warranty or merchantability or fitness for a particular purpose.

10) CHANGES TO THE TERMS OF SERVICE

FurnTech reserves the right to revise its policies and the Terms of Service at any time with or without notice.
